What is it?

Occupational risk prevention (Prevención de Riesgos Laborales, or PRL) is not optional — it is a legal obligation for every employer in Spain, regardless of company size or sector. The Law on Occupational Risk Prevention (Ley 31/1995) requires businesses to identify the risks present in their workplace, implement measures to eliminate or control those risks, train employees on how to work safely, and document all of this systematically. Failure to comply exposes the business to Labour Inspectorate sanctions, civil liability, and, in the event of an accident, potential criminal responsibility for management.

Documentation you will need to provide

  • Description of all activities carried out at each work centre, including machinery, tools, substances, and work methods used
  • Floor plan or layout of the premises
  • List of all employees with their job roles and tasks
  • Any previous risk assessments or prevention plans already in place
  • Records of workplace accidents or near-misses in the past 12 months
  • Details of any subcontractors or external workers who regularly work on the premises

Key deadlines

  • The risk assessment and prevention plan must be in place before any employee begins work — there is no grace period
  • Employee health and safety training must be provided at the time of hiring, when job functions change, or when new equipment or work methods are introduced
  • Workplace accidents that result in more than one day's absence must be reported to the labour authority via the Delt@ system within 5 working days
  • Serious accidents, fatalities, and dangerous occurrences must be reported immediately by the fastest means available and confirmed in writing within 24 hours
  • The risk assessment must be reviewed whenever working conditions change significantly and at least annually as a matter of good practice
