What is it?
A Labour Inspectorate visit (Inspección de Trabajo y Seguridad Social) can be triggered by an employee complaint, a cross-check of Social Security or tax data, a sector-wide campaign, or a random audit. Inspectors have broad powers: they can request all employment documentation, conduct interviews, review working time records, check Social Security registrations, and assess health and safety conditions — all without advance notice in most cases.
The consequences of an inspection can range from a simple requirement to correct a minor irregularity to substantial financial penalties, orders to pay outstanding Social Security contributions, or even criminal referrals in the most serious cases. The outcome depends heavily on how prepared the company is and how it responds both during and after the inspector's visit.

Documentation you will need to provide
- All current and recent employment contracts, including part-time addendums and complementary hours agreements
- Monthly working time records for all employees (obligatory for all companies since 2019)
- Payslips and Social Security contribution records for the inspection period
- Prevention of occupational risks documentation: risk assessment, prevention plan, and employee training records
- Minutes of any safety committee meetings and records of subcontractor coordination
- Any previous inspection reports, requirements, or sanction notices
Key deadlines
- Written allegations against a proposed infraction notice (acta de infracción) must be submitted within 15 working days of notification
- Administrative appeals (recurso de alzada) against a confirmed sanction must be filed within 1 month of notification of the sanctioning resolution
- Working time records must be retained for a minimum of 4 years and made available to inspectors on request
- Any corrective action required by a formal inspector's requirement (requerimiento) must be completed within the deadline set in the notice, typically 10 to 30 days
